Terms of Business & Agreement for Professional Services

This Terms of Business ("Engagement") sets out the terms and conditions upon which the Client will engage Elsworth Associates Limited ("we", "us", operating the Veterans Redress campaign) as the Client's Claims Management provider in connection with the proposed Services.

1. The Services

We provide claims management services in relation to enquiries about hearing loss and tinnitus that may be linked to service in the UK Armed Forces. Where appropriate, we may introduce you to a solicitor experienced in military hearing loss claims, who will confirm their own terms with you separately before any legal work begins.

Other than the content you own, we and/or our licensors own all the intellectual property rights and materials contained in this website. You are granted a limited licence only for the purposes of viewing the material contained on this website.

2. Scope of Engagement

You are specifically restricted from all of the following:

• publishing any website material in any other media;
• selling, sublicensing and/or otherwise commercialising any website material;
• publicly performing and/or showing any website material;
• using this website in any way that is or may be damaging to this website;
• using this website in any way that impacts user access to this website;
• using this website contrary to applicable laws and regulations, or in any way that may cause harm to the website, or to any person or business entity;
• engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this website;
• using this website to engage in any advertising or marketing.

Certain areas of this website are restricted from being accessed by you and we may further restrict access by you to any areas of this website, at any time, in absolute discretion. Any user ID and password you may have for this website are confidential and you must maintain that confidentiality.

3. Fees and expenses

We operate on a no win no fee basis. Our fees range from 15% to 30% + VAT of the gross settlement, depending on the value and complexity of the claim. The exact percentage applicable to your claim will be confirmed to you in writing before you agree to proceed. If your claim is not successful, you will not pay us a fee.

You have the right to cancel this agreement within 14 days of signing, without charge. If you cancel after the 14-day cooling-off period and your claim later succeeds, we may charge for work reasonably undertaken up to the date of cancellation, in line with the fee scale set out in your agreement.

In these terms, "Your Content" shall mean any audio, video, text, images or other material you choose to provide to us or display on this website. By providing Your Content, you grant us a non-exclusive, worldwide, irrevocable, sub-licensable licence to use, reproduce, adapt, publish, translate and distribute it as necessary to progress your enquiry or claim. Your Content must be your own and must not invade any third party's rights. We reserve the right to remove any of Your Content from this website at any time without notice.

4. Regulated Activities

Elsworth Associates Limited is authorised and regulated by the Financial Conduct Authority (FCA Firm Reference Number 834626) to provide Claims Management services.

This website is provided "as is", with all faults, and we make no representations or warranties of any kind related to this website or the materials contained on this website. Nothing contained on this website shall be interpreted as advising you.

5. Standard terms and conditions

In no event shall we, nor any of our officers, directors and employees, be held liable for anything arising out of or in any way connected with your use of this website, whether such liability is under contract. We, including our officers, directors and employees, shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this website.

We are permitted to revise these terms at any time as we see fit, and by using this website you are expected to review these terms on a regular basis.

6. General

You hereby indemnify us to the fullest extent from and against any and all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these terms.

If any provision of these terms is found to be invalid under any applicable law, such provision shall be deleted without affecting the remaining provisions herein.

Acceptance of Terms of Business

By signing our agreement, or by instructing us to proceed with your enquiry, you confirm that you have read, understood and accepted these Terms of Business.

Letter of authority

TO WHOM IT MAY CONCERN;

This letter is to confirm that I have given authority to Veterans Redress, a trading style of Elsworth Associates Limited, to liaise on my behalf in providing information and guidance in the matter of hearing loss and/or tinnitus I believe was caused by noise exposure during my service in the UK Armed Forces. Please therefore accept my instruction to liaise, and to provide all information, documentation or other file copies that may be requested on my behalf.

Free alternatives

It is possible for you to present the claim for free, either to the organisation or person against whom you wish to complain, or to the relevant statutory ombudsman or compensation scheme applicable to your claim.
